What to do when a debt settlment company are cone artist that got you sued by your credit card?
-
I've been having financial problem due to my health (cancer) and got behind on 2 of my credit card bills. I want to pay them but they really got out of hand. The interests, the fees. I just need help. Then I found a company from yahoo answer to help me with debt settlement. Someone swared by them that they are great and was able to settled with great discount. I called the company; they are actually debt collector but accept cases of debt settlement (confusing?). They agreed to accept my case. I paid the man (the owner) and signed power of attorney so they could represent me. This was in June. The man told me these two cases are easy and he should get be the offer in my favor. I waited for months. He told me there a clog in credit card companies because so many people defaulted in this economy. Long story short, he led me on for months until yesterday when I got a court date from one of my credit card. They were suing me. I was suspicious and called them. Because, after all, if we are still settling how could they sue me? Capital One, my credit card, told me the settlement company never called them. I finally settled the debt by borrowing money from my family. The thing is, I trusted them because they have web presence and we signed a contract that they'll represent me. I had no idea they are cone artists. They are out-of-state. If there are in town I would take them to court, The money I paid them was $150. What should I do? I plan to call my credit card company to dispute the $150 but it has been so many months? Worst of all, I believe they never contacted the other card company. HELP!

Answer:
Your first mistake was believing spam. Any answer here touting some place to handle debts or bad credit loans is likely a place to avoid. Someone who swears by them likely works for them. Your second mistake is not realizing what debt settlement is. Even if they try to do it, creditors do not have to accept it and can still get a judgment against for the full amount you still owe anyway. And if your credit was not already trashed, it is now. Just curious if they gave you anything in writing saying what they would do for you or if they offered any guarantees of anything at all?

these outfits are currently being investigated and if you have a case against one you should probably forward your information along to the federal agency doing it and that would be one dealing with consumer fraud
Consider yourself lucky that it was only $150.
