How do you file for bankruptcy?

How can I re-open my bankruptcy file without an attorney?

  • I filed for bankruptcy 3 years ago, I just recently pulled my credit only to find out that some of my creditors were still reporting that I was late on my payments for the last 3 years. Needless to say my credit is worse now than it was 3 years ago. I contacted my attorney to let him know and it turns out my certificate for completing my credit education corse (which you have to take online in order to file for bankruptcy) was never submitted. I have proof that I met all the requirements. Someone just didnt send them with my file. My attorney wants to charge me an additional $700 to re-open my case and submitt my paperwork. I think it unfair to have to pay again when I paid the full fee to get this taken care of in the first place. I REALLY need my credit to be fixed finally. So, my question is, can I submitt my paperwork myself and have the courts aknowledge it so that my creditor can stop reporting the wrong information or do I have to suck it up and pay my attorney again to re-open my file? Please help

    This is a new one on me but I suggest you go down to the Bankruptcy Court and pull your files and let them review it with with you.

Your attorney is an idiot. It would seem the most basic of things to get your bankruptcy approved etc would NOT be overlooked. He should do this gratis in my opinion. Didn't you pay him to file ALL the paperwork? That's why you hire an attorney, because as a layman, you have no idea what the heck you are doing. I would file a complaint about this "attorney" with the local bar. Maybe that will get him to follow through as he should have 3 years ago.

If he did errors then it should be his responsibility to fix it for FREE. I would seriously consider going to your local court office and requesting copies of all the bankruptcy case. Then I would take it to the attorney. If he refuses then you could file a claim against your attorney to the state bar association who approved his attorney license. Obviously tell him that you'll be doing that if he doesn't do it for free. If this doesn't get resolved, I'd highly recommend finding another attorney, ask for references and make sure they know what they're doing. Cheers!
