Who do i contact about sears and hsbc for stealing money off of a sear solutions credit card?

i have a sear solutions card with a max of 300 on it. i payed at a sears location yesturday 200 on the card. the bill was due the 17th, i payed on the 17th, and now im getting charged a 36.00 late fee, and they say i am over my limit, and i have added up all the charges and no matter how i do it, it doesn't even ad up to over 250.00 on it. can someone tell me who i contact to turn them in for stealing money off the card just to make more money? and it is in my husbands name, he added my name to the card two months ago, and now theyre trying to tell me he nev er did, but i was there, and i know he did. is anything i can do?

Being named on the card has no connection to your problem. Even if they had named you as an authorized user, it would not affect either the confidentiality laws (they can only talk to the primary cardholder, or to you with written authorization). If the bill was due on the 17th, and you paid on the 17th at a Sears location, you should have a receipt of the payment. Photocopy the receipt, send it in a formal dispute to HSBC (this must be done in writing) and send it certified mail. Request the late fee be refunded. If your balance was 250, and they added a $36 late fee, and the interest for the previous month, then you could easily be over the 300 threshhold. While your written dispute is being investigated, HSBC must take the charge off your balance, and not accrue interest charges against you. If they find they did not make an error, then the fee and interest will be added back in. Be aware, that some credit cards require that the payment be received at the processing center by the due date, not at an outlet. Many credit cards and banks, merely mail the payment made at branches to their processing center, at which time it is processed as received. If that is the case, it is burued in the terms and conditions when you got the card, and however unfair, it is legal.

First, make sure they have given you credit for all your payments on the day you paid them. If they made a mistake and didn't post your payment, that could be part of the problem. If the payments are ok, then the next thing to do is to check the back of the bill, specifically the part about how to pay your bill. There is probably a warning that says payments have to be received by 10:00 a.m. in order to be considered paid that day. If you paid after that cutoff time, that may be why they are telling you you were late. Always, always pay at least a week in advance so you don't get caught by this trap. As far as the balance goes, see if there is a beginning balance on the account. If that amount, plus the new charges, plus the late fee of $36.00 pushes you over the $300, then that is why they are telling you you are over your limit. If any of these suggestions is causing you the problem, then the only thing to do is to call the 800# on the card and ask them to remove the fee as a courtesy, since you did make a payment. They might do so. If they won't, then at least make another payment to bring yourself below the $300 limit, and stop using the card until you get it all paid off. You might want to apply for an account with a different bank in your own name to get your own credit. Start with a local credit union. They are usually more understanding.
If you read your card agreement you will see that your payment must have been received by some time on the 17th such as 9:00 AM or 3:00 PM. If you paid on the 17th your payment probably didn't go through on time. It doesn't matter if it got there 5 minutes late. It was late and the late charge is proper. There is nothing you can do. In the future you need to pay several days before the due date to be sure your payment is credited by the due date. Remember, it's not when you pay that counts, it's when the money actually gets credited to your account. If you wrote a check it might take a few days for the check to clear.
