Is there anything I can do to get my money back from this ebay seller?

I bought an item from an independent seller on ebay and they sent the item by Fedex early January....Only problem is they sent it to the wrong house because I never got it....I checked the tracking number and it says "signature service not requested" or something....Meaning if Fedex doesn't know where you live, they will just leave your item anywhere with no signature! I contacted Fedex and they told me there's nothing they can do until they get a claim form from the seller but I don't even know if the seller has sent out one.... I'm sort of in a helpless position....The seller has my money, I dont have the item I ordered, and Fedex won't help me without a "claim form" filled out by the seller!!....Ebay apparently told the seller they can't do anything because it says "delivered" on the tracking number and there's no way to know I didn't get it....What can I do???

Jungle Jones, Is there anything you can do? YES! You must always remember this...eBay & PayPal are like one company. Meaning since eBay bought out PayPal for millions of dollars a few years ago, they have set out to insure that it's members/buyers receive a pleasant buying experience almost every time. So if a buyer has an unpleasant experience and made unhappy, that is potentially one less customer they may have in the future and they can't have that. Therefore eBay & PayPal go out of there way to please buyers and NOT sellers! Bottom line? You can file a dispute with PayPal for non-delivery of the item you purchased, but never received. They will immediately send an email to the seller and ask them to address your dispute/claim. If they don't address it within a certain time period the buyer (you) wins by default and is reimbursed. If the seller does respond, he/she has to provide proof positive that the item they shipped was delivered to YOUR ADDRESS! Of course if they are unable to do that...you win again! When you file your dispute/claim with PayPal just explain what occurred just like you did in posting this question. I'm sure you'll end up getting your money back. You could also let the seller know you'll be leaving them with some nasty NEGATIVE feedback which will hurt they're feedback percentage if they don't help make this situation right. Sellers HATE buyers leaving negative feedback because it ruins their reputation on eBay. Wont the seller turn around and leave you negative feedback also? NOPE! Sellers CANNOT leave buyers ANY negative or neutral feedback comments. Remember, eBay favors it's BUYERS. not sellers. Hope this helps and good luck with the dispute!
