How does the paypal system work on E-Bay?

Who will Ebay favor in this case, me the seller or the buyer?

  • Someone has recently purchased an T-mobile HD2 from me off eBay without a return policy option. Before he placed the final bid he messaged me if the phone was unlocked. I responded No, it was tmobile locked, also Tmobile was mentioned in the title and description. When he won the bid and had the phone shipped over to him he then messaged me that his at&t simcard works with the phone but only allows an edge network, not 3G like he desired and wanted a full refund. I responded that i apologize for his grievance but will not issue a refund because the phone has no issues and he is using it on another network that was not intended for the phone. A day later eBay has informed me that a Buyer protection case was been submitted against me and he states in his claim that he went to the tmobile store to use a tmobile simcard and the phone kept rebooting and also states that the tmobile rep has declared the phone faulty. He also states that i have been unhelpful but would like to resolve before escalating it to eBay. It is really suspicious that a at&t simcard can work on a tmobile locked hd2 besides the slow network no problem, but a tmobile simcard will not work because the phone device is faulty and keeps rebooting. I have already responded to eBay and fully explained the situation and submitted all mine and his emails through eBays email server and wish to escalate for eBay to decide a final answer. But i have heard horror stories of con artists manipulating the buyer protection system and winning usually by default most of the time. What are your opinions and who do you think eBay will favor.

    Unfortunatly Ebay usually sides with the buyer no matter what. I have had similar probs with Ebay and i have never won as a seller but have always won as a buyer. If Ebay sides with the buyer you will have to give a full refund. Note... be carfull as Ebay does not require the buyer to send the item back if the buyer wins hope this helps and good luck
