Car with failed emission test?

Hi! A bit more than a week ago I bought my first car (I'm from VA) and a couple of days later 'check engine' light came on and the car failed emission test. When I looked up carfax report it says that the car failed emission test but it was too late anyway. Can I legally sue the seller for intentionally selling the car with failed emission test? I did signed 'as is' agreement....What are my options???? Thanks

where i am, it has to pass the tests before it is sold. check that out. ( CALIFORNIA resident)
