How to legally transfer title if seller owes money on the car?

  • i am buying a car from a private seller in ca who still owes money to the bank. i am buying the car for 13k he still owes 6k on the car he wants to meet at the bank so i can pay off the car and then i would give him the rest of the cash after paperwork is done and the bank releases the "title' now i say 'title' because the bank dosent keep his title on hand so the lender will give us a dmv form for everyone to fill out and then i take the form to the dmv and they send the title to my house is this the legal way to transfer a title if the seller still owes money on the car in ca

    Yes that is the best way to do it, Go to the bank with he ,if the bank is the lien holder they will have the title have hand ,they should give he the title once the loan is paid in full , I would not just take the title and go , the best way would be to have he to go over to the DMV office with you and have all the papers changed over into your name right then .Good luck with your new vehicle'
