A drunk driver hit my parked car what do I do now?

about 12 am Sunday morning a drunk driver hit my parked car at my house. I didn't noticed nothing until i heard a loud commotion of people arguing outside. I saw my mom outside standing in the front yard then i noticed she was looking at a car on the side walk. I then came out to see what had happened. Then I look at my car and the whole rear was completely smashed in,my bumper was across the street, my back window was shattered, my poor car was just a complete wreck. So as I came out the driver of the vehicle tried running away from the scene. Luckily all the people that were arguing with the driver who crashed had already called the police ahead of time. So when the driver tried fleeing the police arrived and were able to get him. The bad apart this is that the driver had his whole family in the car. He had his wife, an infant, two toddlers, and two other adult family members. I don't understand why the wife or the two other adults didn't take the wheel if they knew the driver was completely intoxicated. He had put their lives as well the kid's lives in danger as well other people. Anyways...I am very sure the police report will show that this all had happened. So now what do I do? I've called my insurance company and am waiting for their call back. What should I tell them? should I tell them exactly what happened of what I saw. I also need a car because I have no way now to get to work and take my 3month old daughter to day care. The car seat she always uses has shattered glass all over it so no way in hell i want my daughter to use it.

Small claims court if you have the name of the driver and if insurance doesn't cover full damage. No lawyer needed for small claims. Proof is needed.

well if im correct his insurance will have to pay for all the damage made on your car,if its considered total loss then their gonna pay you what the car is worth and keep your car,and at that point you could either buy your car off of them or go looking for a new car...
You may have to take them to small claims court if you want them to pay damages. Many insurance policies carry an exclusion if the insured/driver was involved in illegal activities such as drunk driving. Hopefully you can just pay your own deductible and have your own auto ins pay. Keep good records of everything, and it doesn't hurt to ask for a new car seat, you seem to have a valid point.
