Car crash, insurance help, what can I do?
-
I was involved in a car crash this part Monday. It happened at the intersection of my street and the main st of my village. I'll try to make this as mentally graphical as possible. Let's say i was going from south to north on my street. I had a green light and as I crossed main st a car on main st coming from east to west passed the red light and hit me in the right front (passenger's view right). Now I am 19 years old and I have a clean record I've never been involved in an accident. I was nervous, I did not know what to do or how this works beyond the police arrival and the exchange information. Thankfully I did not get seriously injured, not even a scratch. I remained calmed and just tried to talk to the lady that hit me. She is about 84 years old and she claims she saw the light from the next block (which was on green). She apologized and declared herself culpable in the police report. The radiator in my car was completely destroyed and leaking so I couldn't take it home. A tow truck took it to a body shop that's near my house. Now, I had to leave home because I'm in college and since the car is registered under my mom's name I left it to her hands. With the passing of the days however, we have not heard from the lady's insurance at all, and the body shop is already giving me a bill for my car stance and the towing. I see it absolutely ridiculous that the bill is directed to me since she caused the accident. Furious, I contacted the lady's insurance which tells me that in her verbal testimony, she declares herself innocent, when the police report says opposite. Her insurance will take up to 3 weeks to conduct investigations and give a final saying. At this point I am about to personally strangle the old lady myself. I need professional help here, what can I do!? Please any information or advice will be really appreciated, specially if professional. Thanks

Answer:
Her insurance company probably doesn't have a copy of the police report yet and are going solely on her version of events. They are required to support their customer when it is a word vs. word situation. To speed this up. get the police report yourself and get it to her insurance company as quickly as possible. This will make their investigation go much quicker so they may be able to accept liability for the accident and then will be able to work with you to take care of your damages. Otherwise you would want to contact your own insurance company and file a collision claim.

This is just the usual delaying tactics all insurance companies employ, they will do anything they can to hang on to the money for as long as they can even though they know they will have to pay eventually.
