Who's at fault - Delivery Driver parked in driveway?

  • Yesterday, while I was backing out of my driveway, a delivery driver pulled into my driveway and parked. This caused me to hit the delivery driver's car. I know it is supposed to be the fault of the person who is backing up, but is a delivery guy allowed to park in someones driveway which is private property in the State of Texas?

These are questions you need to ask your insurance agent or lawyer. In general I believe private property is just that. If this person was trespassing on your property to make a delivery to someone else then there's a pretty good argument for fault. The first thing you should have done was call the police department and made a report. Basically, if he wasn't there when you started backing out of your driveway, then pulled in while you were backing out, it's probably his fault for coming in behind a moving vehicle. I know I don't pull out behind someone who's backing up.

it depends on whether or not the driver was going to your house or just using your driveway to turn around. if he was using it to turn around, it's his fault because it's your property and he had no business being there.
