Who's at fault - Delivery Driver parked in driveway?

If this person was trespassing on your property to make a delivery to someone else then there's a pretty good argument for fault. The first thing you should have done was call the police department and made a report. Basically, if he wasn't there when you started backing out of your driveway, then pulled in while you were backing out, it's probably his fault for coming in behind a moving vehicle. I know I don't pull out behind someone who's backing up.

it depends on whether or not the driver was going to your house or just using your driveway to turn around. if he was using it to turn around, it's his fault because it's your property and he had no business being there.
