When is a car exempt from title transfer in massachusetts?

Car dealer did not transfer title properly. What happens legally if he doesn't transfer the car I paid for?

  • I just recently bought a used car a few days ago. The dealer gave me the old title and a title change slip, bill of sale etc. The car is not a lien, so that isn't a problem. I took the information to the DMV and they said I couldn't register the car because the auto sale place( car dealer) did not flip the title to their name before transferring it to me. I have a title with the previous owners name on it, not the dealer's information. Which is why I can't register the car until the dealer transfers it properly. The dealer said he would meet me at the DMV on Monday to transfer everything. I'm now scared he won't show up on Monday and I will be stuck with a car that I can't even register. I'm extremely frustrated right now.This is my first car and I can''t believe a car dealer wouldn't know better than to to give me a title that isn't properly transferred. It is only Saturday night and I have to worry about this **** until Monday. I paid $2000 for this car and this is ridiculous and totally unfair. The car is insured also, which cost me a lot. I have no more money to spend on another car. If he doesn't show up on Monday, what legally can I do? What if he takes forever to transfer the title or doesn't do it at all, then what? Please help. '

    First off Otto is wrong the title does get reassigned to in the dealers name if there is room on the title and if there is not room then the dealer has to send the title in for a new title that comes back in the dealers name. Now for you did the dealer give you a 30 day temp tag?If so he has to write his dealer # on the plate.well most states if it is on the tag and he does not show up take it to the dmv and they can track the dealer down.The other choice is to look up the last owner and call them and get the info on who they sold the car to then track them down if it is not the dealer you bought the car from.I hope this guy shows up,there is another way it is (not legal) but you could write up a bill of sale and go in and get the title and plates for ur car,but leave all the paper work the dealer gave you at home.

I would worry if the dealer does not show up. Is this the first time you have bought a car? The title is not usually put in the dealer's name between sales. This is why the dealer names don't tend to show up on a vehicle report.

It is not your first car. It is not your car at all. You did not buy a car. You paid for a car. There is a big difference. The car does not become yours until the title transfer is complete. If the dealer does not complete the process, then you could sue the dealer, but give it a few days. This is probably just a paperwork problem.

If this dealer has a proper license and place of business he will show up on monday to resolve your Dmv issue. Don't anticipate a problem that may not exist.
