Rear end car accident-Insurance says I'm at FAULT?!?

  • I was driving along, following a driver that was going slow. He slammed on the breaks and caused me to hit his car. He didn't have a reason for slamming on the breaks either. Now the insurance says I'm at FAULT, not the driver in front of me. He caused the accident by slamming on his breaks for no reason, not me. Why should I be at fault for an accident caused by the other driver? His insurance should pay me for my car and injuries, not the other way around. His insurance premium should go up, not mine. He's at fault not me. What should I do?

    Yo Dipstick! Tailgating is ILLEGAL in all 50 states. Patient people don't tailgate. Only jerks that don't leave enough time and have to SPEED (also illegal). Slow down; don't push; smell the roses.
