Can I return a car back to a dealer?

Can a car dealer return a car you sold to them?

  • my friend restores classic broncos. and he recently sold a 68 ranger to a car dealership who wanted to buy the car for their lot. he clearly stated, with a long disclaimer on ebay motors, that the car was not perfect and needed a bit more work. he sold the car to them, signed over the title, and put the money in the bank.. the dealership calls him a week later stating that the cars paint wasnt perfect and that it handled terribly at highway speeds (broncos were made to haul farm equipment, not be hot rods) and that it leaks. the dealer now wants all their money back and is threatening to sue him and ruin his online name which he uses to make a living. please help with any legal insight.

    The dealer is a professional. He knew what he was buying and how he was buying it. (as is) No judge would side with him and he wont sue. One negative feedback wont ruin his online reputation. Its ONE. I Lots of great sellers have 1-1.5% bad feedback. Ebay is not going to do anything either. The dealer has nothing to lose by trying to bully him. But he does not have a legal or moral leg to stand on. I was a car dealer for over 15 years and never, not once even had the gall to ask anyone for my money back. Im a big boy and I don't hold others to a standard above my own. (And I would not give refunds)

Unless he can interpret a buyers mind, there is no way to clearly define his word or description and the buyers. It is all subjective, or in the buyers point of view as to what may be a bit or a little more work. The best way to sell vehicles to dealers especially is Sold As IS No Warranty express or implied. That way there is no I wasn't told about this or that or It was more work than I was told. The only recourse is either let him take you to court and hope a judge rules in your favor or give him back his money. Remember if you do return any part of his money you are showing you may have misrepresented the item.
