Can i get my money back from car dealer if car is no good?

My Younger Brother Just Bought a Car 2003 But my Question Is Can He get his Down Payment Back The car was Bought May 22nd & It did come with a 30Day Warranty! BUT The same day He drove the car home it turned off on him right off the freeway & He called the dealer right away!! The Dealer had him bring the car back and gave him a loaner car But a few days had passed he had got his car back & Then it starts Smoking he returns it again that same day dealer says once again i'll have my mechanic look at it a couple days pass from then he gets the car back & now the car will not start dealers say's its my brothers fault so dealers comes picks up the car once again & quote say's" it must be sum thing you are doing to the car for it not to work :/" so the car is at the dealership once again being fixed by a mechanic & we have asked for proof that it's being fixed but he says he don't have to show my brother ANYTHING! We are just sick of dealing with this guy and car can we get are money back because this seems like a LEMON VEHICLE!!!!! Also Told us we cant have the number to the finance company....and the dealer stated he must make the car payment when he has not even had the car for a DAY!!!!

1. Lemon law only applies to new vehicles. That includes the term "lemon vehicle." Your car, is not a lemon. It is a used car. 2. No you can't get your money back, just because you're not happy with the purchase. They are currently upholding their warranty, so there isn't anything they've done wrong.

Your an owner. These are your problems and what you agreed to when buying a USED car. All the dealer is responsible for is repairing it as the warranty stated. No returns & no refunds.
It is a USED CAR, not a "lemon". He is responsible to honor his contract. You have probably pissed them off by your repeated contacts telling them you are unhappy with the deal. You could have avoided this whole thing by having a reputable mechanic look over the car before you bought. They are holding up their end of the bargain by honoring the warranty. You need to do the same.
You can ask them, but I doubt you can get your money back... You bought the car as is, if it was a new car, would be a different story, then you would be using the manufacture warranty.
