Can I return a car to the dealer?

  • I purchased a car at a used car dealership two weeks ago exactly. It came with a 1000 mile 30 day Maine State Inspection warranty. Within a mile of driving it off the lot the Check Engine Light came on. Brought it back the next day and was told O2 sensor but the O2 sensor was fine. They cleared the code. and I was on my way. When I got home the CEL came back on and the Check Brake Light came on. I brought it back the next day (Saturday). They checked the Breaks and the sensor. Told me the code instead was an evap leak. They cleared the code and sent me home. Just before I got home both lights came back on. The dealership ordered the parts and I set up time on Tuesday to have the service done. Tuesday the O2 sensor was replaced. The breaks were too new to be the issue. They cleaned some connections and no break light since. Tuesday night my CEL came back on. Called the dealership and setup some time yesterday (wed) to have it looked at again. They could not determine the issue, cleared the code and just said it was an old code. I picked up the car today and once again as soon as I left the lot the engine started to sound throaty and it lurched every time the car shifted (automatic). When I turned the car back on later that night the CEL was flashing. I drove it across the street to VIP and the code read a misfire on all four cylinders. It goes without saying that I am POed at the dealership. Besides hoping that the dealership will agree to refund the purchase price of the vehicle is there anything else I can do to get my money back?

    Used cars are sold "As Is", unless they gave you a written warranty. If not, you own it now. I would try taking the car to a different shop and just pay to find out what the problem is ASAP. They may be just try to string you along till they clear the warranty period. But to answer your question, NO, they do not have to refund your money ever. They only have to repair the problems if they warranted the car.

Nope. Warranty = They repair it Warranty does not equal Money Back Guarantee You're stuck with it unless you sell it or junk it.

A warranty is a promise to repair problems covered under the warranty. It is not a money back guarantee. You are not entitled to a refund. It is the buyer's responsibility to determine the condition of a vehicle before buying it.

Own up to buying a POS. That is not the dealership's problem that you liked that car enough to buy it no matter what was wrong with it. Dealers are not baby sitters. One of these days, that will sink in to anyone on here who posts a similar question...
