Can a car dealership make me sign a new contract?

Can i get out of my car contract.???? All info needed....?

  • Okay, well first i am in California. I had a totally paid off Chrysler 300 (paid for in cash). But now my family size is growing so my boyfriend and i decided that we needed a much bigger car. So to make a long story a little shorter, we had taken it in & traded it in for a Town & Country mini van almost 30 days ago. We got $9000 value for our car towards the van. The van was $16,995. So we signed the contract and got a payment & keys. Now the dealership keeps calling saying that i need to sign a new contract because they got a new lender. (not sure why the first lender fell through) But i wanted to make my payment and they keep taking their time on giving me the info until i sign the new contract. So i am wondering if i am binded to this contract or if i can get out of it still.????? Now they are telling me that i can just make the payment to them and thay will just add it to my trade-in value of my car. Another question of mine is if i should or have to make my payment to them without having a lender???? If not what could happen.????

    You cant walk away, your old car has probably been sold. Regardless, you are not getting it back and giving their van back & it not costing you anything. You are obligated to the deal you signed but ONLY the exact deal you signed. If you want to fight over it you can probably get around paying a payment this month but no real savings in the long run. They cant change any major terms in your contract except the lender. If you refuse to sign, your van could be repoed. The dealer could carry your note themselves in which case you would owe them the payments every month.

Under California law , you must have acceptable financing . If you don't sign the new contract , the repo man will take the car , and you will end up with nothing . Your only option is to come up with the entire amount owed , immediately
