What should I do about receiving a faulty product from a purchase on Ebay?

  • Hi, I just want to begin by wishing you all happy holidays and a happy new year! I recently purchased a remote controlled car from Ebay as a gift to my dad. Before completing my purchase I read over his reviews and thought that everything would go well. When I first received the car (12-23) I did not want to open it because the car was no for me. After settling down, my dad decided to try the remote controlled car today, but something was not right. As soon as we placed batteries inside, the car would not start and after fiddling around with it for a while the car still did not work. This is the first time I have had any problems with an Ebay purchase. The person who I bought this from stated on the listing that there is a 7 day money back (I pay for shipping). What should I do? I contacted the seller, but I don't want to just sit and wait here especially if he may want to just try and burn off the next couple days so that I cannot return it. Should I open up a complaint with Paypal? Thanks!

    Yes. Initiate a PayPal complaint since they usually guarantee items purchased via paypal. It may not have been the sellers fault. Things can get damaged during shipping for example but it's not your fault either. But in the future, make your purchases at WalMart or some other reputable place. eBay is full of scammers and ripoffs and you really shouldn't use them unless it's absolutely necessary.

Yes. Initiate a PayPal complaint since they usually guarantee items purchased via paypal. It may not have been the sellers fault. Things can get damaged during shipping for example but it's not your fault either. But in the future, make your purchases at WalMart or some other reputable place. eBay is full of scammers and ripoffs and you really shouldn't use them unless it's absolutely necessary.

Don't worry you have 45 days for a Paypal claim of SNAD(significantly not as described) and the seller stating 7 days to return is not correct - as you have 7 days to notify them in writing of your intention to send back (an email/ebay message will suffice) Give your seller the chance to rectify this with a replacement or a full refund- and as it is faulty I would be expecting/demanding the Seller refund your return P+P (Tracked and insured to its value for your safety) Communicate your intentions to him in the next few days- see how he responds/helps or not. Otherwise go straight for a claim If he is a Business Seller you also have other recourse for you refund under th DSR's (Distance Selling Regulations) and can force him to collect his item at his expense (if he didn't state on the listing that Buyer pays to return) and you must have your refund within 30 days (the law) regardless if he has collected/arranged pick up of the item PS I realise I have quoted UK/EU LAW regarding DSR but you must have similar in US Protection for buyers when purchasing online
