How does a Check get canceled after a month?
-
So here is the story.... I cashed a check and its been close to a month now it completely cleared and all i checked with the bank and all. Well we got a phone call yesterday and it was the bank stating that the check had been canceled on us and we had to pay back the money so here is my questions for you 1.) How long does a company or a person have to cancel a check? 2.) How is it that after a check clears it can be canceled. to top it off after almost a month 3.) How come they cant keep the money if it cleared. 4.) how can the bank state we knew it was going to do that and claim we done it on purpose It ended up being a scam so go figure we get screwed over and have to pay the money back but the sheriff stated bank cant do anything but make us pay it back but they was saying how they was going to put a thing out for me until i explained no joke 20 times what happened. but the check everything was real company and all stated it was really on the bbb site and everything so that's why we trusted it for whoever reads this dont trust anyone you dont know uness your good luck and nothing but good luck For 1st person Im not stupid i get that i was trying to figure out some info and not for you to state that i have a sheriffs report the night we found out and like i stated as long as im paying it they said it was fine just has to be 200 a month and i have to check in with him on times im going to miss because of rent week since they got all our money in the account and he knew if was a scam found out im not the only one through them that this happened to through the same bank and all they no longer except checks from that bank he stated. For person 2 thanks for most what you said i do get i am the one to pay it back and all and that im lucky thats all it was and it didnt come with more than what i got you answered what i needed to know and for whoever im not stupid enough to try to do something like this again but when family does the same thing and says its fine and its someone you trust so much you would think it was fine. But trust me/us we will never do something like that again

Answer:
That was a fraudulent check so bank can cancel it at anytime. Lucky the bank did not press charges and have you arrested for fraud. Pay what you owe and lesson is never accept checks from people you don't know

1. There is no time limit on cancelling the check 2. The check does not clear in 3 days. Your bank makes that money available to you as a courtesy but it can take up to 4-5 weeks for the check to actually clear 3 - The check was counterfeit. In most of these cases, the counterfeiters use the name and account number of a real company. That's why it seems to clear. But then once the check is cashed and the cancelled check is returned to the payee at the end of the month with their next monthly statement, and the bookkeeper is balancing the books they notice a check they did not write or that is out of sequence, they report the fraud to their bank who informs your bank who cancels the check 4 - The bank has NO way to know that you didn't know the check was fake to begin with. Everyone caught passing bad checks, even if they knew they were bad, tries to claim that they thought the check was good. The only proof that you were scammed would be a police report If you did not file a police report right after you found out the check was fake, then bring a copy of that police report to your bank manager, then the bank has no way to know that you were a victim not the perpetrator of the scam But even with a police report, you are still responsible for paying back the check as you are fully liable for anything deposited into your account. Read the non-profit Fraud Aid's website http://www.fraudaid.com/check_liability.htm "You cannot rely on your bank, credit union, PostBank, or check cashing store to protect you from counterfeit, stolen, or forged drafts. It's not their job to watch out for you, it is your job to watch out for them. Like you, merchants, banks, and credit unions have the rightful expectation of being given good money. BY LAW YOU ARE LEGALLY RESPONSIBLE AND FULLY LIABLE for any and all checks or money orders deposited into your bank account by you or someone else, and for any funds wired into ANY of your accounts by you or someone else. Your are 100% liable for any and all funds deposited into any of your accounts by any means whatsoever."
