How Does Per Diem Maternity Leave Work?

    There is no US law requiring paid maternity leave. If a company wants to offer paid maternity leave, that is up to the company, but less than 25% of the biggest companies in the US do so. Under the Family Medical Leave Act, certain companies are required to give you unpaid maternity leave (and unpaid paternity leave) for up to 12 weeks, with exceptions: To be covered under FMLA (Family Medical Leave Act): Must work for a covered employer (all public agencies; private companies with 50 or more employees within 75 miles.) Must have worked for covered employer for at least 12 months prior, and at least 1250 hours in previous 12 months. Other restrictions apply. Again, some employers will give you unpaid maternity leave even if you or your employer don't meet the requirements. California is the only state that does mandate a paid maternity leave.
