Can i return a magic jack to best buy that i bought on ebay?

• i purchased a magic jack at best buy for $40. that evening while surfing ebay, i came across the exact same product for $10 less and bought it, planning to return the best buy one. however, i have learned the magic jack from ebay won't be here for a couple of weeks and we would like to set it up as soon as possible to have a home phone. my question is, can i open the magic jack i bought from best buy and use it now, then when i receive the one from ebay, return it to best buy? they are exactly the same, unopened packaging and all. thanks in advance
