Can a -Reasonable Accomodation- request get my mom out of a -Project-Based Section 8- Bldg. ?

She is in a -Project Based Section 8- and is exposed to deathly amts. of 2nd hand smoke. She is putting in a -Reasonable Request- for a place with less smoke. The Housing Authority Supervisor (boss of her tech) told me that it will be hard b/c there is "no bldg. that they have that is smoke free stipulated". I stated, . "Chances are that anywhere would be less smokey probably". Supervisor did not disagree. She stated, "Well, fill out a -Reasonable Request- form, and have Doctor state something concurring with this smoke hazard. I had told the Sup. that though they can't discriminate against smoker's smoking in their units, . .that I had read the lease and that it states in two places that it is a breach if any tenant poses a "health hazard" and interferes with "quiet enjoyment" of other tenants. That prompted her suggestion of the -Reasonable Accomodations- request form. -If- . . there is no building that is smoke-free, or with a smoke-free addendum in the lease that is a -Project-Based Section 8- bldg., . . then... since we have an acquaintance/friend who has a Duplex that does accept Section 8, but who's prop. mngmt. company does not refer to his duplex as Project based, and both units are vacant within the duplex, . .can it easliy be submitted to the government or the Housing Authority or whoever as going from Section 8 . . to . .Project Based Section 8? Is it such a big deal? Can this be done? I know landlord/owner would be willing, I think mngmt. co. wouldn't mind. Also, would Housing Authority just say, . ."Hey, we can't get your mom a smoke-free place in a Project Based, so we are altering policy to accomodate her (her inability to breathe pure smoke) . .and switching her over to Regular Section 8 w/o making her wait until Section 8 opens up again in a year or whatever". Also, . .would it sweeten the pot if I got on Project Based Section 8, and assured him that I am doing this for the principle reason of taking up residency in the adjoining unit (so that both his units will be filled with myself and my mom)? This is if he went with the option of declaring it Project Based. If he kept it Regular Section 8, and it was Housing Authority that bent, . .then that would be good for my mom, and he would not be doing anything that he may have never thought of before, and he would not have to be concerned with getting a different kind of tenant in the other unit. Generally, . .are owners or property mngmt. companies more wary of Section 8 tenants, or Project Based Section 8?

Unless she has a Section 8 voucher, she can only move to another site-based Section 8 building but she might have to go on that building waitlist. Your Mom should call her case worker and ask if there is another building Mom can move to.

The best thing you can do is to contact the Fair Housing department of HUD, they will determine what a reasonable accommodation is. The only problem is, this being project based, she can't be moved elsewhere; however, she could be moved to an end unit or somewhere where smoke is less likely to bother her. Anytime you feel that the housing authority isn't treating you fair contact your HUD Field Office. Believe me, they will come, they will investigate, and they will kick someone's *** if they're wrong!!
