I received a writ of continuing garnishment to garnish my own wages - what do I do?

  • I am self employed, but do not pay myself 'wages'; I just share the company's money as I need it. I have both business and personal bank accounts, but that is mainly for the merchant account acceptance (they required me to have a business account), and the promotions the bank offered me. I don't have any real distinguishment between me and the business when it comes to income. A lawyer I owe money to (for a case they lost for me) has been very aggressive in trying to rack up charges and inflate the debt (now up to over 5k, from less than 1500), and in trying to collect that debt. The most recent method was this writ of garnishment. Since I am not set up as an employee of my company, and since I do not write paychecks, do I have to do anything? The wording of the writ of garnishment is (to me) vague and no help - it doesn't specify any amount to be garnished, whether a percentage or set amount, or anything besides the length ()180 days) and who to send the checks to... Where can I find more information? I plan to file for bankruptcy soon, and primarily including this debt; so I wish to avoid making any payments until that is started - but I do not want to break any laws!

If you are incorporated, the business income is not your own, unless you're a S-corp or LLC, in which case, you will have to pay. I suggest you file for bankruptcy immediately.
