Is DirecTV's loss of channel 9 a breach of contract?
-
I have been subscribed to DirecTV for over a year now and I want out of my contract. After the promotional period ended, my bill doubled in price from $45 to over $90. I am in the process of finishing installing an antenna to pick up the local, over-the-air channels, which is primarly what I watch anyway. With the recent issue of DirecTV not being allowed to broadcast tribune stations, in my situation WGN channel 9 out of Chicago (which is the number two channel I watch), are they in a breach of contract by not providing all the stations I signed up for and not providing any compensation for the loss of that station so that I can end my contract with them without their penality of $20 for each month remaining on the contract, which in my case is 7 or 8 i believe.

Answer:
No you cannot get out of your contract without paying a penalty, as far as the channel lineup, DirecTV has a contract with each of the networks they carry, when the contract expires, they have the option to renew that contract with the network or drop it all together if an agreement cannot be made. They are in no way liable in any way as far as what channels they carry. They do say that their channel lineup (depending on the package you sign up for) is subject to change as necessary.

Not at all. Take a look at that contract and you will see that their channel lineup will change as stations become or cease to be available.

Highly unlikely. Did you read your contract? It most likely includes a clause that frees DirecTV from responsibility if they lose a channel. You remain obligated to the full terms of the contract you agreed to - extremely unlikely that they have any obligation to compensate you for anything.

It would certainly seem like a breach of the contract. But I bet a dollar, if you read through the thousand or so lines of fine print, you will find that you gave up the right to make that claim when you signed up.
