Claiming child benefit- who will it be granted to?

  • My ex partner, my son's dad currently claims child benefit for our son, i signed this over to him when i left him 2 years ago, mainly to keep the peace (he wanted the child benefit so he could receive increased housing benefit). However im now in a position where i need the child benefit and keeping the peace is no longer as important to me as 2 years ago when i just wanted to get out of an unpleasant relationship. My son is with me 4 nights a week and 3 with his dad. I know that his dad is not going to just hand over the child benefit, so my question is, how do the child benefit office decide who the benefit should be paid for when both parties do not agree? What do they take into account? I don't want to put in a claim for it if i'm unlikely to be sucessful as this will just cause me unecessary aggravation from my ex partner. People that have have racked up a "top contributor" rating on yahoo answers by trawling through it all day leaving a trail of cutting and witty comments that are of no purpose except for that person to feel good about sticking a virtual two fingers up at someone they've never met. If they cannot agree, then HMRC will decide.... http://www.cb42.org/ So I suggest that you try to get a discussion going, as there is no guarentee that the existing arrangement will be changed. Of course, if you can show that you are doing the primary caring (and buying) and therefore costs fall more on you, then it would help. But it seems to be decided on a case by case basis..
