Can i take my landlord to court for this?
-
So me n my boyfriend was living together and both our names was on the lease about a month ago now we moved out do to shots fired into our apartment that wasn't intended for us but I didn't want to take any chances living there because I have a newborn baby and it could very well happen again so I moved out...around the time that I moved out me n my boyfriend wasn't on good termsand I was paying the rent. My landlord knew this because I went to her once before and asked her could I kick him out but she told me i didn't have that right because it would be like me evicting someone but she could do it but she never did. So now that I moved out she calls me and saids we are sending you your rent and security deposit in the mail but we need an address(keep in mind she's a nasty old mean lady with a very bad attitude) I gave her my moms address and told her to put it in my namesince she knew I was the one that paid it she said ok whatever and just hung up no have a nice day or nothing. When it did come in the mail to MY MOMS HOUSE it had my boyfriends name on it. I tried cashing it but no place would let me. I took the checks back to my landlord and asked her why she did that when she knew I had already told her that was one my moms address n my boyfriend doesn't stay there with us and two its not his money its mind. She looks at me and saids are you done talking ms....whatever your name is I said yes so can you fix these checks or I wont be able to cash them my boyfriend would have to and we are not together at the moment so he's not going to give me the money if I give him the checks for 550 she laughs and saids o well guess you better get your love life back on track hands me back the checks and saids there's nothing I can I said so what am I suppose to do she saids idk but what you can do is take the checks and leave because im going to lunch goodbye...... I was smart enough to record the conversation on my phone of her being so rude

Answer:
you would have to establish who paid the deposit. If it was 50/50 (which I doubt), then you could sue him for your half (if you indeed paid half). If its his money then leave it be. In no even though is the landlord liable for anything.
