Stciky situation about a car...i need legal help maybe?
-
A couple of weeks ago, my roommate, who is also a really good friend, let me borrow her car...A little history on the car, it has been totaled before and she payed about $1000 to fix it. She hit the metal ball of a truck while switching lanes on traffic so the front was completely wrecked....Couple of months later, the car was "fine" but every now and then smoke would come out from the right side of the engine. I mentioned it but I don't think she felt like it was an issue. Then..a few weeks ago, I asked her if I could use her car for the first time because I didn't have mine at the time and she said ok. After I dropped her off work, i drove back to the house to get something really quick. when I parked, I realized it was smoking again but since she didn't tell me anything about it I figured it happened before and nothing would go wrong. I turned the engine off, went inside the house and left. It literally takes 5 minutes from her job to the house. just FYI....So I left and got on the highway..as I was driving, maybe for 10 minutes or so, Hot water and oil started leaking from the inside, and the entire floor matt got soaked. As that was happening, the car started smoking a lot more than usual and the smell was strong so I immediately pulled over and waited for the car to cool down. Obviously the engine got over heated. I tried turning the car on again after The smoke stopped but it didn't work anymore. Everything happened in matter of 2 minutes or so, basically as I was switching lanes to get to the emergency side to stop...Long story short, the car got totaled and the engine just broke down completely, and to fix it she would have to get a new engine, basically costing her another $1000...Now where it gets complicated is what should I do or what is the right thing to do legally. its hard because she is one of my best friends. She's not mad at me and it was basically an accident and how everything happened was unexpected. I didn't know the car had problems, but at the same time I didn't check the meter when I saw that it was over heating because everything happened so fast! basically as I was pulling over. Now I helped out with towing because that was the least I could do since I was the driver. She ended up getting a new a car and putting down $3000 as a down payment. But yesterday, I talked her about the car again but her mom and everyone else is saying that I should pay her $2000 for the car since i totaled it and my friend is the one that had to pay for it. They didn't fix the car, they ended up putting it in the junk. From what she was saying I should pay $1000 for what they spent to fix the car previously and another $1000 for what it would'vr cost to fix it now... She never told me the car had problems or to be careful. In my mind i thought the car was fine and nothing like that was going to happen. What she's saying is that what really made it sticky is the fact that I went back to the house first and saw smoking and still drove it. But that happened before and the car was fine. So idk what to do now, or how to handle it legally...like is it fair for me to pay $2000 or how much should I pay since they decided to put it in the junk? I really need help figuring this out legally and not have problems with my friend because money sometimes can get involved and that ruins everything. What should I do?

Answer:
it doesnt cost money to send a car to a junkyard: therefore you owe her no money. its her car and her problem: shes responsible for what happens to it even if she wasnt the one driving when it got destroyed. it was her decision to junk the car and buy a new one so no, DONT give her any money. Its her problem, let her deal with it.

I would give her half of what it would have cost to get it fixed.

By the sounds of your little but long scenario. the cooling system on the POS was severely neglected till its dying day, unfortunately for you it happened on your watch, it was going to happen anyway, it just comes down to your generosity, do you feel you owe her anything for something that was going to happen to her anyway? face it you just have bad luck, it could just as easily been her sitting on the side of the road.

With all that going on, you should never have driven it. It would have blown up on her the next day. Just a POS that nobody cared about.
