Fishing and boating arizona question?

I took a friend fishing on my boat. I asked him if he had a fishing license and he said yes. Afterwards i found out he lied to me and did not have a license. A few days later another friend notlified me that as the captain of the boat, i was responsible for the passengers and i could have also been ticketed and fined by the arizona game and fish warden. The guy is 47 years old and i don't feel it is my responsibility to visually check another adults fishing license however i don't want to be fined either. Can the game warden issue both him and i tickets for him not having a fishing license???? I have a fishing license.

YOU ARE RESPONSIBLE . . . While you are not directly responsible for him, you indirectly are responsible for his actions in your boat. Your friend not having a license, would result in him getting a ticket an paying a fine. But the problem could go much further. . . You could find yourself in serious consequences as a result of him not having a license. For example, (and this happened to someone I know): This guy in my marina took a friend out for a day on his boat fishing. They had a great day, and both caught their limit. As they were pulling anchor, up cruises two Game Wardens in one boat along side. That's when the "fishing buddy" is discovered as having no fishing license. As one Game Warden writes the fishing buddy a ticket for not having a license, the other asks to see their day's catch. Now, the owner of the boat, and the only one with a fishing license, gets a ticket for poaching as it is obvious he has twice his legal catch. He is instructed to follow the Game Warden to shore, where he is met by local police, arrested for poaching, his boat confiscated. Now of course, this most likely would not have gone as far as it did, had the "fishing buddy" not told the Game Warden he wasn't fishing when he couldn't produce a license. True also, is they fact they both probably had a few too many beers, and in fact were lucky they didn't get a BUI. Arizona pays up to $8,000 rewards for turning in poachers. Where do you think this reward money comes from? Answer: Fines paid by poachers. So. . . No you would not be responsible for your friend not having a license, but as owner of the boat the two of you are in, you sure are responsible for everything else as a result. John

You're not responsible to check your passenger's fishing license. It's the same situation if your driving with a friend, you get tired, and he switches over with the driving. It's not your responsibility to check to see if he is actually licensed. Better than asking Yahoo, call up your local wardens and ask them. It would be good to start a dialog.
