Can you cross into the US from Canada when you have a pending court date?

I was recently caught shoplifting at a grocery store. I stole about 30$ worth of food. There was something that showed up on my record for the same thing when i was 17, but i never had a court date. Just a fine, but i had never paid it. The cops didnt make a big deal about it though. They told me i have will receive a letter for a fine of about 250$ and a court date. I am going to New York in 3 weeks, will i be able to cross the border?

Since you have been charged (either by Appearance Notice or through a Promise to Appear) and you have a court date you now have that info captured on CPIC (the police database). What this means is that the US authorities would have access to this info when you attempt to cross into the US. Since you have a court date they may deny you access to the US in fear that you are not intending to return and will remain a fugitive in the US. I'm not saying you won't get through, I'm just saying you may not. It's at the discretion of the boarder officer.

Wow!!! You didn't even bother to pay the fine on the first offense just because you had no court date? You've done the same thing again and now wish to leave the country for an undetermined amount of time but now you do have a date in court. I would place a telephone call to your lawyer...and I hope you have one this time, and ask if they would allow you to leave. If you cannot at least do that...don't be surprised at anything!!!

Thats up to the Canadian government more than the American Government. You'll have to have a passport and if you do it's likely you'll be able to cross if you have a visa of some kind
