Can I be a probation officer with a deferred felony?

California: Driving on a suspended license while on probation. Does my PO have to violate me?

  • My question is regarding california probation officers, I would appreciate the opinion of anyone who may have had a similar experience or knows someone who has. I plead guilty to a DUI in Jan 2011. Spent a night in jail and was given the standard first time DUI penalties. (ie Informal probation, Sherrifs Labor, 4 month DUI class, fines). To put it simply I did not take the situation seriously at all and was subsequently terminated from the DUI class and Sherrifs Labor Program. Ultimately a warrant was issued for failure to comply with the terms of my probation. At this point I knew I had a warrant and wanted to have enough money togother so that I could pay the bond ammount and not have to go/stay in jail when I was able to sort everything out. During this time I was arrested (and recieved a complimentary beat down) for treaspassing, using foul language in public, resisting arrest (felony), and assault/battery on a peace officer. I should probably get used to people judging and labeling me a knuckle head for this but the truth is I was being an a**hole and 4 police officers whipped my a**. Still with me?? Ok. Spend a week in jail and was released when I went to court. Took a plea. 3 years felony probation, 180 days of Sherrifs Labor( in lieu of jail), AA meetings, 4 month DUI class, and of course FINES. Please understand that felt fortunate for that outcome. I registered and began all of the required programs. Probation office told me that I would get a PO within 3 months and to wait for the call. About a month later I was pulled over and given a citation for driving on a suspended license. I was not arrested and the officer (thankfully) did not tow my car. Getting to my question. I think that I am adequately aware of the possible consequences. I know that have clearly violated my probation and could be required to serve the remainder in jail; there will also be additional penalties for driving on a suspended license, a violation that was stipulated in the terms of my probation. My questions are: What do probation officers normally do with this? How does the fact that I have not been assigned a probation officer affect this?? Is it mandatory for a probation officer to violate you for this or do they have some discresion?? Has anyone reading this not been, or know someone who was NOT violated? Also, if my probation officer violates my probation is LIKELY that I will serve the ENTIRE REMAINDER of my sentence in jail/prison? I realize that I am completly in the wrong here. I drove when I should not have driven and will have to deal with the consequences of my decisions. I am not looking for legal advice. I know that it is always advisable to obtain legal representation for these matters, and I am definitely not looking to be lectured or ridiculed about the mistakes Ive made. I believe myself to be a good man and cannot imagine anyone else could make me feel worse about my current circumstances. At this point I am pretty sure that my probation will be violated and I will go to jail. Perhaps I deserve this, but I think that would depend on who you ask. I know my wife and daughter would defininely not agree. All opinions are welcome and appreciated especially from those who have been through a similar experience. Thank you for your time.

This doesn't even come under "sometimes decent bloke messes up". This comes under "total loser and d*ckhead who is nowhere near EVER being a good guy and is just a criminal". I would expect that yes, you will be violated, especially given your past, and have to serve time in jail. If you still have a wife when you get out, then she is a very foolish woman.
