Where and how to report overstaying tourist?

How I can go back to the US (still having a valid tourist visa) after overstaying my visa and living there 5y?

  • Ok, I lived in the US for 5 years. I was there for a marriage that did not go through and I got divorced before going through immigration. i did get the documents and started working though and stayed there after, living and paying my taxes and everything. Leggaly I was ilegal I guess because my marriage did not go through. Total I was living illegal there propably 2 or 3 years. I left on May 2008. I stll have a valid tourist visa. Can I go back for vacation for example? Do they keep a record of my exit (I did not given anything back upon my exit). Can I company work on a work visa for me if I get a job there. If I need to fly for an interview I can? Thanks. Any help is appreciated.

    your tourist visa wasn't officially revoked when you overstayed, but it certainly will be if you try to go back, because you violated the terms of that visa on your last stay. That's probably worse, since they'll almost certainly let you on the plane if you try to use it, but they won't let you in the country. instead at that point, they'll revoke your visa and sent you back on the next plane home. and yes, they absolutely do keep a record of your exit. since you were out of status for several years, you are ineligible for any visa for 10 years from the time you left, or until 2018 by your information above.

You are under bar to reentry. No chance you are returning to US. If you did not turn in your I-94 when you departed, they may think you are still illegally present in the US. When they catch you at the immigration desk, you will be returned or deported, and start your 10 year bar from then. Or if they know you left after illegal stay, you are still under bar to reentry, and attempting to return while under bar is subject to 20 years in prison, then deportation and permanent bar to reentry as convicted felon. Don't even think about attempting to enter the US. You fouled things up but good.

You can only apply for a waiver if you have an immediate relative here in the USA. I would consult with an immigration attorney in your country to try to convince the American government about when you have left the country so they don't think your here any more. I never heard about anyone trying this, but you never know. I had talked to these so called top immigration lawyers on this website and I can say that they are full of lies. I'm an immigration law student and you be surprised how these immigration lawyers do not have the most recent updated immigration laws. You will be able to come back here one day, it will just take a lot of time. I wish you the best of luck with this issue.

3 year overstay gets you 10 year ban from entering US even with valid visa. You have to wait 10 years from May 2008, until you even attempt to enter US.
