How can i get a new title for my car?

Bought car, can't register it without smog, car won't pass smog so I can't get title - can I sell it and how?

  • Here's the situation: My girlfriend's dad is moving and has many vehicles (he's a mechanic). For too complicated of reasons, he didn't want to sell or junk these cars. Instead he just gave em away to friends. He gave me a 91 Ford F-150. It works - its awesome - i love it - however, im not a truck person nor an American car person. So I was just gonna sell as soon as he gave it to me. He said he doesn't care and I could do whatever I wanted with it. He gave me the title and everything. Here's the kicker though - it won't pass smog. So I can't get the truck fully registered in my name with the California DMV unless I can get it to pass smog. I called around - its gonna cost $200 just to have someone give me an estimate on what its gonna cost to fix it. I got an estimate from cashforjunkcars and they said they'd give me $350 for it. I know the trucks worth way more cause everything about it works and is totally bad@$$! So my two questions are: 1) Can I sell it without the title by just signing a bill of sale or something - and of course telling the buyer the reason why I dont have the title to give them. And 2) how much do you think truck enthusiasts would be willing to pay for a pimp 91 F-150 that runs and is awesome? Should i ask for like $600 and just be willing to negotiate?

    In CA there is a maximum amount you have to spend for repairs. I think it is about $600. You could just spend that and then you can get a smog certificate as a "gross polluter" and then sell the truck. The buyer will be able to drive it for 2 years.

If you are very lucky, you can sell it AS IS.

Try what Chuckles said. In NJ, that's called a waiver but it has strict conditions: vehicle must be old enough [ I used it on an 86 Honda that failed smog for NOX, nitric oxide.]; Owner must meet a threshold amt in attempting to repair the violation [ I think it was $400 then]; If granted, it's good only for 1 yr; It's not transferable if vehicle is sold. Depending on your geographical location, maybe offer it to buyers in neighboring states. Might get good money selling it to Mexican buyer. Convenient in Tahoe or Chula Vista, not so much in Lompoc
