How Can i Get Death Certificate in INDIA ? Please see details?

  • My grandmother was expired 12 days ago at the place other than her own permanent residential address , in other city of Punjab . But she passed away at the relatives place with whom we are not in the talking terms . They hv registered false complaints to get separated from everything of her by taking her in confidence before she was passed away . So they got chance to do rituals during the time of cremation and we failed to get the intimation forum from cremation ground . Now to clear all the false complaints from court ,we need to present a Death certificate in court so the complaints by decease are to be withdraw . We need to present Death certificate within 21 days as court said . Now the other party who got intimation forum has not submitted any document and registered for Death certificate till yet and chance to get submitted is very little in this case. Can we living at other city obtained death certificate of my grandmother from the place where we are living ? I mean if she passed away in ABC city and We are living at XYZ city , Can we obtain Death Certificate from XYZ city if her permanent address and our permanent address is same and we are residing permanent at same address ?? If No , can we obtain it through RTI ??? As per law any family member can obtain death certificate ...so how should we get the death certificate in case we are not in talking terms with other other party who is holding the intimation forum . Can any of u adviced and tell me the procedure ???

If you know the date of death, you can check in the register of deaths at the municipality or corporation. If death occurred in a village, then check the register of deaths both at the village panchayat and Tahsildar's office. If you know only year of death, search would take a little longer. If officials' cooperation can be 'secured' even in one day it can be checked. If the death is found recorded, then you have to apply for a death certificate in as many copies as needed, by paying the fee prescribed. Even this can be done the same day, if cooperation is there. In this case, remember, place of death is important and all other details are irrelevant for the purpose of death certificate. If the death is not recorded, then the procedure is lengthy and may take months. First you have to apply to the Municipality/Corporation/Panchayat/tahsi... of Taluk office. The authority will decline your application on grounds of no record being available. You have to file a suit against the authority, in the jurisdictional civil court, for direction to the authority, to register the death and to issue certificate thereafter upon application. You have to engage a lawyer and lead evidence of one or two witnesses, as advised by the lawyer, to prove the fact of death of the person, at the particular place and on the particular day. Thereafter, the court would issue orders as prayed for. You have to apply for certified copy of the order (better 2 copies), attach one with your application to the authority concerned, to register the death.
