Yes, it is illegal. A person owns the rights to his/her image for marketing purposes. After his death, his estate owns those rights for the heirs. If you want to sell stuff with pictures (in any style) of dead artists on it, you will need a licence from the Estate of each of those people. Elvis made well over $50 million last year. I hear Michael Jackson made even more than that.
