I want to fire my lawyer?

  • So far. I've been arrested as a Felony/Conspiracy back in September 2011 because my friend stole $60 on random things and he followed me the whole time. The agents did not believe me at all for not taking anything since he kept following me without any knowledge. After bail, I hired an attorney and I had a court in 2 weeks but the case had no record. On January, I have a court date dropped to Petty Theft (MISC). Since my charge was dropped, I agreed my lawyer to pay 5K but I only payed him 3K since im a student. Now that my next case is on April 2(something), I feel like I can take it care by myself and so far my lawyer has done almost nothing. I have an appointment with the lawyer on the weekend and I just want to know if its still possible to fire him because I expected to get my case dismissed but he keeps getting extensions since I never took anything from the store. I know I owe him 2K but I feel like the service was not good and I am not satisfied. I want to leave him with 3K then fire him, is that possible?

    How old are you? If you are under 18yo then your record would of cleared by 18 anyway. But i agree with the others and if your lawyer is the one who got your felony down to a misdemeanor then why sack him now? He could of lost potential clients by taking up your case. I don't think you're allowd to pick and choose how much YOU wanna give him. But he might be able to drop the charge completely. You risking the chance of getting found guilty and also you probably won't do jailtime (depending on your record) you'll still have possible fines, community service and this on your record. Why was it a felony if it was just $60 in items stolen? Stealing over $2,500-$3,000 is usually considered a felony.

Even if you fire him you'll still be responsible for the balance of the amount you agreed to pay him. Have you told him about your dissatisfaction?

If you signed any sort of contract aggreeing to pay him, you cannot legally just fire him and forget about it; however, if you only orally agreed to it, then you may be able to, but be warned: since we are talking about a lawyer, he may find reason to sue you for not paying him in full.
