Tips for a first-time waitress?

Can a waitress going on unemployment in California collect benefits for serving tips?

  • I've been working at a restaurant for two and a half years and now that the season is ending I would like to file for unemployment. I'm just confused on whether or not I'm allowed to include my tips. Obviously as a waitress I live off my tips, and the restaurant I work at is pretty pricey so the tips are very good money. I only make minimum wage working about 20 hours a week without tips I would make virtually nothing on unemployment. So my question is, can a waitress include tips when collecting benefits from unemployment? Thanks in advance.

    You sure can. Just report the actual amount you collected: salary plus tips. The UI folks will verify that with the restaurant, and yout UI benefits will be based on your actual earnings. - Stuart

In my state, it's based off of your reported wage. So if you didn't report all of your tips back then, then it'll be only off of your reported wages. I know a bartender whose job burned down and she was screwed since she always underreported. Be careful though because if you quit your job, most states do not allow you to file for unemployment unless it is a hostile working environment. Even then, it is hard to get unemployment. If it is considered a seasonal job, you also may not be eligible for unemployment. Plus you weren't full time so you can't get unemployment for being dropped down to part-time status.

you must report all wages to the government and to unemployment. you may qualify for partial benefits depending on exactly how many hours per week you work and how much you earn. if you leave what you earn out and they find out from the employer after you received any benefits you will be required to pay any money back.

i recently resigned after 26 and 7 months at this company, here in Southern California. Work/management got so bad, that I wasn't getting the support needed to succeed in my work. Management singled me out on every little detail / mistakes. In all my years there, my reviews were excellent.. Just had a review in late January and it was so bad, it was almost comical to hear what they told me. Certain management from other departments, always respected me and knew I was a hard worker. My employees loved me, and felt I got disrespected and mistreated. I did go to HR and complain and nothing was done. So I decided to resigned, due to being hostile. Now tomorrow (Wed 2/24/16) I have a phone interview w/ EDD to see if I qualify for unemployment. I've sent out like 30 plus resumes to certain companies and I've only gotten 2 interviews but didn't bold well, since they haven't called me back. I'm only 45 years old and need to find a job soon.....
