Will I receive a structured settlement?

  • Two years ago I slipped in water that another employee had spilled and neglected to mop up, and injured my left thumb and wrist. I have been through 2 surgeries, months of physical therapy, driven hundreds of miles to see several different doctors only to be told last week that there is nothing else that can be done. I was then told that I will have to live with the pain and I can't return to my job at a very well known dialysis company. I live in North Carolina and I have an attorney. My question is how large of a settlement should I expect, and will it be a structured settlement? I forgot to mention that I am a 50 year old female and my use of the hand is very limited, for example, if I go out to eat with my husband and order a steak, he has to cut it for me! Also the pain is excruciating at times. I have to take medicines for nerve pain to be able to sleep. My salary at the time was about $18000 a year.

Personal Injury calculators base their numbers on age, expenses, previous income, whether you can use the hand, etc to calculate the figure. Without knowing those details it is hard to say. Plus you didn't say whether the company is settling with you or whether you're going to court. More than likely, if you have a settlement, it will be a structured settlement. Apparently courts are using them in cases for as little as $5k so it is a high probability of you receiving one.

Who are you suing? Are you suing your company for negligence? You should be able to recover your medical bill + lost income if you win the case. It is hard to tell what's the final amount you will be receiving. You lawyer will be the one who negotiate the settlement deal with the other party Structured settlements are tax efficient and can have asset protection and spendthrift advantages too. Also you have the flexibility to "cash out" for a lump sum with a factoring company if you need big amount of cash
