What are my legal rights?

My house sits on someone else's property, as the legal owner of my home, what legal rights do I have?

  • Answer:

You don't state how why your house is on someone else's land, do you have a lease, then you have the rights given in the lease. You may have an "adverse possession" claim, laws do vary from state to state.

That's a tough one. My friend just divorced, and felt as if she had rights to half the house, but the house sits on his father's property. In reality, she had no claim at all to the house. If the house is "yours" but the property is not, you may have a right to move it off the property, but if it is a solid structure meant to be permanent, you should really see a lawyer who knows the state laws where you live.

If you know a lawyer, call and ask. The laws involved are state, and vary from state to state. if you don't know a lawyer, call Legal Aid, or the local chapter of the Bar Association.

None if you are in cali

Better call a lawyer and check property deeds for accuracy.

It depends on what state you live in. In colorado, if you have owned and lived in your house for 20 years, then you own the land it stands on. It is called adverse possession. I had a job in indiana where someone had built a house on company land. The company had owned this land since 1848. This house, was built with a deed that used trees as boundary markers, and was 20 feet off. The company sold the land for the house, though under indiana law, they did not have to. You really need to talk to a lawyer.

You have a deed to the house. You have the right to move your house. The owner of the house pays the taxes on the land and has a deed. Squattering the land is not allowed in most states. Not anymore in this state. And paying back taxes on land does not get ownership anymore.
