Can I obtain my deceased fathers mental health records?

  • My father was a diagnosed sociopath. (anti-social personality disorder) My sister and I are trying to obtain his mental health records in order to better understand, and to help in our journey of healing. Does any one know if we can legally obtain these records? He has been dead for 5 years, and lived in Oregon. Thank you!

    You do not have the right to your parent's psychiatric/mental health records. There are no such laws or statutes, nor should there be. It was his treatment and had no connection to you. If the treatment was mandated, that might change things. You would have to demonstrate a meaningful need through the courts, which isn't likely. You can try: plenty of clinics aren't very smart or knowledgable of the laws and they may give it to you.

If they don't respond, then you can legally subpoena them. Second, a therapist may not take extensive notes. After a session, I may write only 2 or 3 sentences. That's because the bulk of the work is done in therapy, not writing about it. You may not get the info you are looking for here. A better idea to understand and get closure, is to do some reading about the disorder. From working with a lot of anti-socials(in prison), I would bet that something negative happened to him in childhood. Good luck on your journey.
