What is my sons legal right as an Autistic child?

What is the name of the form to keep another parent from moving out of county with a child?

  • I have been told that there is some kinda of form that we can file to keep another parent from moving further away. If you have any knowledge of what this form is can you please let me know. My husbands sons mother decided just a couple of days ago that at the end of this week she is going to pick up and move almost 200 miles away. She does this all the time. We are in the process of seeking legal counsel. Since the beginning of the school year he has been in 5 different schools and not only has a numerous amount of absences but tardies as well. He is in the 6th grade and has very poor grades. His mother does not make him go to school. He has the state Starr testing that he is currently preparing for. We are at least wanting to keep him in the same school til the end of the school year. I fear that if she succeeds in moving him in schools for the 6th time this year it will definitely do more damage than good. Please help me. I am looking out strictly in the best interest of the child involved. I have four children of my own and their education is top priority to me. I love my step son as much as my own children. We do not have a lot of money due to the fact that we do have such a large family. I filed with legal aid as soon as we learned about her intentions to pick up and move again. PLEASE we are desperate. I will do what ever leg work that I have to. I just need to be pointed in the right direction. Any help that you can give me is greatly appreciated. Time is definitely of the essence. There is an existing child support and custody order. My husband is current on child support and pays over $800 a month. We currently live 20 minutes away in a different city. I have taken him to school myself several different times because his mother has been unable to when they live one block away from his school. I do not mind doing this as long as he goes to school. We also learned recently that she gives him the choice to go to school some mornings. This is incredibly unacceptable. Any info can help!

  • Answer:

The document I think you are trying to describe is an injunction. This is the court telling someone they may not perform a certain act and informing them of what will happen if they go ahead and do it.

actually if its in the divorce decree that see has to stay within a certain distance . He could take her to court and say see is not abiding by the court order and wants custody of the child and if he was one block away he could easily walk to school and in 6th grade he should be responsible enough to get him self to school http://fathersrights.com
