What services are you getting from the state of calif (specifically harbor regional) for your autistic child?

Should I get child support modified? My daughter's mom will not help with child care.?

  • My ex and I have two daughters together. One 9 and one 5 yr old. My 5 year old has been begging to come live with me and her mother has been indifferent towards her. Packed her bags and everything. I'm going to pick her up next week. Told her she can stay a few weeks. I fear she has been suffering there with her mother and not getting the needed attention. I live 3 states away and work fulltime so she will need child care. She is very bright and supposed to start kindergarten next fall but her mom has totally pulled her from pre-k and has had her mother staying at home with her for about 5 months. she did this last year too. Mind you, the majority of my child support costs ($1150/mo) is based on my 5 year old needing daycare services as school is not mandatory until in her state until a child turns 6. She is a very active 5 yr old so I know she must be bored to death with them. My ex wants me to take her temporarily and on occasion has asked me to take both kids permanently but when I mention modifying child support she starts back pedaling. She makes about 90k a year so I don't really know that its cause she needs the money. But my support is about the same as her mortgage. She wants me to take my daughter but she doesn't want to help support her in my care by sending back some of my own support money. How do I handle this?

    Go back to court and get the child support modified. Sounds like she is the type of person who will do what she can to keep dragging in the money from you. Look after yourself, before you change the living arrangements.

You talk to a family law attorney. Any modification of the children's living situation or care provision can result in a review of the support payments. Obviously sending support to your ex for a child who is living with you does not make much sense. Personally, I am extremely concerned about splitting the girls up as they have each other for support, and moving three states away is a huge emotional upheaval for your daughter. If she stays for three weeks, then around the time she is getting comfortable you will be sending her back. You might want to sit down and have a serious conversation with your ex, or fight for full custody, but do something that is good for your girls. Good luck.
