If you just bought it try taking it back and telling them its damaged within 14 days they should just give you a replacement. As for repair, cds are made by burning the patern into the disc so a little scratch or mark will send the reading laser off somewhere else and create an error, for some scratches it is possible to "polish" the disc using a special cd polisher, quite a few shops offer this service now. if its deep then no there wont be enough left when its finished.
