How would I avoid paying a bounce check fee... being ripped off?

  • Last Dec I sold an item and the woman paid half now and then wrote me a check for the other half to be cashed in Jan... me being the trusting idiot thought that would be fine... the day before I went to cash the check she came up with an excuse not to and asked me not to cash the check until Feb... so I waited... then the day before I went to cash it she told me she made a mistake and wrote me a check on her joint account which had no money in it and that she would send me the right amount in a week... in a week she came up with some other excuse... meanwhile she is on my facebook and I am watching her get new computers, packages, and everything then she says she has no money and that her husband did not work that week or what ever excuse... so we worked it out that she pay me with taxes... taxes came she came up with another excuse not to pay me... I know the longer I sit on this check it will become void... and finally she was suppose to start paying me in payments and she told me that she was home sick all weekend yet on Facebook she was logging in getting her hairdone... I know I am getting taken advantage of... I was wondering if I can just take the check up to her bank and just cash it and wash my hands of the whole thing...? or would I get fined if it bounces or would they have to check first to see if there is money in the account first? will they notify her that I tried cashing it if they deny me? I am hoping they wont even check and they will just let me cash it without checking I dont even want to ask the bank to check...and let me be on my way and let her deal with the after fall... if is a $250 check...but I have a feeling it wont be that easy... I really dont care anymore what happens on her end (I know sounds heartless)... I been going in debt trying to work with her and she just keeps taking advantage and I do not want to do small claims court... and all that... so any help or suggestions would be great... I know I am an idiot so I dont need to be told that... thanks...

    You should go to her bank to cash it. If she has enough money in her account, they will cash it for you. You don't have to explain anything to them. All they care about is that there is money to cover and you have proper I.D. If she doesn't have money in her account, then wait a day or two and try again. If you deposit into your account at your bank and it bounces, then yes there will be fees. So you don't really want to do that. Once the check bounces, you would have to go to small claims court and file a complaint. In most jurisdictions it's against the law to pre date checks or to write checks without sufficient funds to cover them.

I suggest you take the check to her bank. Inform the teller that you have had problems trying to cash the check because the person keeps asking you to wait. If the account has fund to cover the check, the bank teller will cash the check -- the bank may charge you a fee to cash the check since you are not a customer. You don't have to worry about bounced check fees. The person who wrote the rubber check will be the one with the problem. Other checks written on those funds will be the checks to bounce.
