Small Claims Court (Ontario Canada)

  • Howdy All I have a friend whose wishes to sue an Organisation through Small Claims Court. He has decided to do this after a number of Lawyers have advised him this is the best option in his case. He has explained to me that the case is neither clear cut and the opposing party will almost retain their own legal council. He feels he needs some really good informtion as to how the Small Claims process operates (in Ontario, Canada) in order to maximize hs chances of winning. (In terms of the issue he is very knowledgeable) Thus my questions are: 1. Are there any really good web sites, pamphlets or books which describe in layman's terms how the small Claims Court system operates in Ontario Canada? 1. Is there any service which for a reasonable fee will provide advice, Coaching etc the best way to handle the case (My friend is prepared to pay a maximum of $500.00 for such help.) Dear mongolia-ga; Thank you for allowing me to answer your interesting question. ?Are there any really good web sites, pamphlets or books which describe in layman's terms how the small Claims Court system operates in Ontario Canada?? The clerks in the Small Claims Courts offices will not guide you on how to prepare your case or provide legal help. If you get lucky you may find one who is not too busy to assist you in correctly filling out the forms, but don't count on it. Your best bet is to get their information booklets and forms and follow the instructions to the letter or your case may be tossed out. Here is a description of the basic process of Small Claims Court so you?ll have a fundamental understanding of what to expect: SMALL CLAIMS COURT OVERVIEW http://www.cmhc-schl.gc.ca/en/co/buho/gucoho/smclco/smclco_009.cfm The Small Claims Court Guides to Procedures can be found here on the Ontario Attorney General?s website: http://www.attorneygeneral.jus.gov.on.ca/english/courts/guides/ http://www.attorneygeneral.jus.gov.on.ca/english/courts/scc/ FORMS: http://www.ontariocourtforms.on.ca/english/forms/scc/index.jsp ?Is there any service which for a reasonable fee will provide advice, Coaching etc the best way to handle the case (My friend is prepared to pay a maximum of $500.00 for such help.)? Yes, in addition, you should read this copy of a booklet here entitled ?How to Make the Small Claims Court Work for You? and a self-help Guide to the Small Claims Court PARALEGAL ADVICE http://www.paralegaladvice.com/scc/smallclaims.htm This site also offers a free referral service where you can get Paralegal advice http://www.paralegaladvice.com/referrals/referral.php Paralegal advice in your area http://www.paralegaladvice.com/advertise/advertisepla.htm Alternatively, one can obtain guidance, assistance and/or representation from one of these qualified attorneys and organizations: LAWYER LOCATE http://www.lawyerlocate.ca/lawyers/canada_subs.php?SubCategoryID=52 I hope you find that my answer exceeds your expectations. If you have any questions about my research please post a clarification request prior to rating the answer. Otherwise I welcome your rating and your final comments and I look forward to working with you again in the near future. Thank you for bringing your question to us. Best regards; Tutuzdad-ga ?
