How much should paying for over staying?

How can I evict a non paying tennant, She is an exgirlfriend that was staying free in my house next door. We broke up and I want her out. How can I evict her?

  • Answer:

Not sure how are other states, but here in florida, if you even invite a friend to stay over night, and they decide they want to stay, you have to go to sheriffs office and start the eviction, and they still have 30 days to move out, I learned this the hard way, so be carefull who you invite into ur house, or rent a room to.

Tell her one of your relatives is moving there from out of town and they need a place to live and she has to move out.Tell her to start looking for another place.Ask her if she will help you clean it up for thier arrival.;)

It depends, some states have a law that states, that if someone is invited in, and stays for at least a month,...they become a legal tenant. But the fact that she isn't paying should give you enough grounds to evict her. If you own the property, and have given her a notice, and she still wont leave, the bast solution would be getting the law invoved.

I would tell her the rent is going up next month and that if she is not ready to start paying rent then, she needs to find somewhere else to live.Make the rent higher than she can afford, with an equal deposit and first and last months rent due on the first of the next month. That is not an uncommon request. And go to your local sheriff's office and find out what it takes to evict someone in your situation. You cant just go tell them to move out and expect them to be out the next day. You may have to get a judgement. Depends on how stubborn she is willing to get.

That depends on the laws in your state. For most areas, you would have to retain an attorney or draft a "Notice to Vacate." If she refuses to leave within the time alloted, you must go to the Courthouse and file an eviction notice. She would then be served, but in my state that can take up to six months.

Depending on the state you are in you would need to serve notice, if she has no mail being forwarded to the address it can be as easy as asking the police to tell her to leave by stating she came over as an over night guest and will not leave or changing the locks, but make sure she is not using your address for her mail.
