Credit Card used to buy jewelry. Not owners card. Is the jewelry store liable for allowing this transaction to go through without the owners signature? They asked for an I.D. but not the owners credit card. I.D. was not the owner of the credit card.

If the person who purchased was an authorized agent, it's ok. The rules of the credit card companies is that to have a merchant account with POS (point-of-sale) card swiper, they are not allowed to ask for photo ID unless a cash customer would also have to show the same ID. The person who used the card could be sued or have criminal charges pressed against him/her.

Was the credit card reported as stolen or lost, to the police? Did the card user have the owners permission to use the card, at any time? Your answers, will determine if this is a criminal or civil act. Bottom line, you will probably only be responsible for the first $50 dollars of that transaction, no matter the outcome.

It depends on where you live. Some states (in the US) hold merchants liable for not properly checking ID, but they are few and far between. The person who fruadulently used the credit card, thus committing a felony, is liable. The jewelry store is actually a secondary victim and out the money on the sale. They, in theory, could file theft charges.
