How do i collect money from my mom?

I am 16 and want to be emancipated i have not been abused physically but mentally i can't stay living with my mother. My father died 3 years ago and my mom gets 800 dollars a month for me, if i get emancipated would i collect that money each month?

  • Answer:

You do not seem to understand what emancipation is. Emancipation means that you are, despite your minority, capable of supporting yourself and being seen by the world as an adult. To become emancipated you must show that you can support yourself, and once emancipated, all support obligations cease. So the answer is no.

G'day Anonymous, Thank you for your question. at 16, you probably could live alone and you could speak to your lawyer. However, you need to think through whether you and your mother are going through a bad patch as happens in any relationship or whether the problems are more long-term. Regards

You should - that money is for you - not for her! Sorry you are going through this :(

In order to be emancipated, you would already have to be living on your own, and supporting yourself. There would also have to be abuse (mental or physical) in the picture. If you're trying for emancipation solely for the money, it won't even so much as get considered by the courts.

If you get emancipated, you agree to do it completely.... and totally.... alone. It isn't easy. It has to be worth being emancipated. YOu have to say "Is leaving the abuse worth more than the comfort of any money"..... and if it is.... then you go for it. You get a shrink to back you up. You write a very rational letter. You talk to the right people. You be willing to do it all on your own.

Technically any money earned the parent has access to until they are 18. Which is why child stars are usually broke because the parents spent it. If you become emancipated then yes you should be able to use that money to pay for rent/food. This money is being used to pay for your room and board. As someone who lost a parent myself at a young age, I have no problems with the fact that my surviving parent used this money to keep us alive and healthy. Honestly, I don't know about your experiences or mental abuse. But Personally with the way teenagers are acting now adays. You probably think you are an adult and want your independence and cant stand the fact you have to do what your parent tells you. It's likely what you think is abuse is good parenting. Until you move out of the house that money belongs to your family... NOT you. It's putting a roof over your head, grow up and be grateful. Sorry to be kind of harsh but like I said I grew up in a very similar situation and I have no regrets.
