Can i quit my job and still get my disability after?

My mother is suffering from severe scoliosis, nerves are pinching, legs go numb, and she gets violent facial spasms, She could no longer perform her job and had to quit.. what does she need to do to get disability when her Dr. states she can still work?

    If the doctors say she can work than there is no way she can get benefits in the U.S. My suggestion is to keep looking for a doctor that will listen to you. You might try getting a work eval done by Voc Rehab. If Voc Rehab says she can't work than Social Security will probably take their word for it.

The first thing she needs to do, is to apply for social security disability. She will be denied the first time, I think they all do that, because some people who apply are not really sick and just want to see if they can get some easy money. It's an automatic procedure that they usually will deny you the first time. When she gets the letter of denial, look for an attorney who "specializes" in social security disability. The attorney will send her to a doctor of his choice, who will determine how bad she is, and if she can actually work. They have certain doctors who work with the attorney to actually determine if the case should be pursued. If the doctor determines she cannot work, then the lawyer will continue in helping her get SSD. She should apply for disability immediately, because if she wins the case, she will be paid from the date she applied for SSD. Many people might tell her not to hire an attorney, because he will take 1/3 of any monies she is entitled to. On the other hand, if she did not hire an attorney, then she would be getting nothing!! When I was diagnosed with CIDP, (it's a rare nerve disease that is very painful) my doctor wrote a nice letter to social security, explaining everything to them, and I did not have to hire an attorney. Her doctor expects her to work like that? She should get a new doctor, and apply for disability (SSI/SSDI). I did.

I'll bet your mom would rather get better than get disability, though it sounds like her condition is bad enough to warrant the latter. Search the web on Schroth method to find information and physical therapy clinics that practice it. If there isn't one near you, find a physical therapist nearby who works with back pain or scoliosis patients and is willing to learn the method. It won't straighten her up completely, but typically helps the pain and ancillary problems as well as stabilizing abnormal curvatures and partly reversing them. See below for resources.
