What is an open intersection?

If a car is making a left turn at a busy intersection and the traffic stopped at the light (green) to keep the intersection open, who is at fault if a third lane (which is on-street parking and not a through lane) hits the left turning car?

thank you, i'm from the u.s.- - south carolina in particular. I was actually asking about the on-coming lane going straight through the intersection, not turning at the intersection. But, the tricky part of it is the fact that they were going straight through an on-road parking "lane", and not an actual through lane. So, while both of the other two lanes were stopped because of traffic, they were speeding through a lane that is designated for on-road parking.

If you are turning left you should stay in the left lane at the end of the turn. Meaning your car should be in the lane closest the double yellow line. If you are turning left and end up getting hit by a car in the curb lane, the car turning left maybe at fault for an improper turn. Most people drift across lanes when turning.
