Can you sue the mall management for allowing their tentants to sell knockoff handbags, wallet and sunglasses. They know they are selling them but are not doing anything about it and my business is hurting from that. I sell handbags as well but not knockof

The only possible way you would have standing is if you entered the lease with the agreement that nobody would be selling knockoff bags, and if the management knew knockoff bags were being sold. The fact that you did not bring this to the management's attention probably ruined any case you possibly had. You also would have an issue with damages. How would you prove how much money you lost as a result of the knock-off bags being sold? Why not simply report these stores to the manufacturers that are being infringed, and the FTC?

It said on the lease that were not allowed to sell any knockoff items. Theres also a post on the office telling all the tenants that they are not allow to sell them. We havent said anything to the management because 1 of the malls employee told us that the management knows they are selling them but they are not doing anything about it. What difference will it make if we tell them as long as they are getting their rent money. Were about to close my shop and see if I can sue the mall management.

Not unless your lease is that specific. The FTC are the people to contact if they are illegal copies.
