How can I get my item back from an ebay buyer?

I sold an item to a buyer on ebay. The buyer filed a chargeback against me because he felt it was not as described. The buyer won the chargeback. Now he has his money and I do not have my item back. He will not respond to me, I have called his house, his work, I have emailed, and I have sent eBay messages. Any help would be appreciated.

you can only work with e-bay. I supose you could file a lawsuit, but I am not certain that would really get you what you wanted.

Ebay is no help, I have tried them. I suppose I will be filing a lawsuit.

If the payment was made through PayPal - screw eBay and contact PayPal. Same company, but PayPal is more efficient. You may not get your item back, but PP will get you your money and kick the other guy off as well. And hey, since you sold it, did you really want it any way? Wouldn't you rather have the money? If they never paid you through PP, depending upon the amount involved you could always take them to Small Claims court and wind up on Judge Judy!! If its a large amount - that would be practical perhaps as a last resort, but if its a small amount, you might have to eat the loss and write it off as a cost of doing business and a life lesson. Thank you! I contacted paypal and got my money back!! I am still considering taking this guy to small claims court, just so I can get my lens too. I also kind of feel like screwing with his life a little now.

You're stuck suing him for return of item. This sounds like a scam, actually. First off, make ever administrator at E-bay know what happened and that this scam was perpetrated. But getting the personal data to pursue the lawsuit will require a subpoena of E-bay's records because, however illegal this is, they won't give up personal data unless they have to (bad for business.)
